Terms of Service – Personal-IQ (IQ Kos AI Solutions)

1. Service Overview

Personal-IQ is a smart, AI-powered calendar management platform that enables users to interact with their Google Calendar through a conversational interface. By leveraging OpenAI’s language understanding and Google Calendar integration, Personal-IQ allows you to create events, reschedule or cancel appointments, set reminders, and manage bookings using natural language commands. Key features include personal calendar assistance (e.g., “Schedule a meeting tomorrow at 10 AM”), automated reminders, recurring event scheduling, and a booking system for business users to let their clients schedule appointments. (Note: Some features, such as public business appointment discovery, may still be in beta or “coming soon” as the platform continues to evolve.)

Personal-IQ is provided by IQ Kos AI Solutions (Petrit Bahtiri and the development team). Throughout these Terms, “Personal-IQ,” “we,” “us,” and “our” refer to the Personal-IQ service and its providers, and “you” or “user” refers to any person or entity using the service. By using Personal-IQ, you agree to these Terms of Service, so please read them carefully. If you do not agree, you should not use the platform.

2. Eligibility

By using Personal-IQ, you represent and warrant that you meet the following eligibility criteria:

• Minimum Age: You are at least 16 years old. Personal-IQ is not intended for children; users under 16 are not permitted to create an account or use the service.
• Google Account: You have a valid Google account. Personal-IQ relies on Google OAuth for authentication and on Google Calendar for core functionality. You must maintain an active Google account and comply with Google’s own Terms of Service and Privacy Policy. If your Google account is suspended or terminated, or if you revoke Personal-IQ’s access to it, you will not be able to use most features of our service.
• Authority and Compliance: If you are using Personal-IQ on behalf of a company or other organization (for example, creating a business booking page for a small business), you have the authority to agree to these Terms on behalf of that organization. In all cases, you also agree to comply with all applicable laws and regulations in connection with your use of Personal-IQ.

If you do not meet these criteria, you must not use Personal-IQ. We reserve the right to refuse access to the service to anyone who does not meet our eligibility requirements or who has previously violated these Terms.

3. User Accounts and Roles

Personal-IQ supports different types of users with specific roles and capabilities. By creating an account or using the platform, you acknowledge the role applicable to you and agree to the terms specific to that role:

• End Users (Personal Users): This refers to individual users who connect their personal Google Calendar to Personal-IQ for private scheduling and reminder assistance. End Users can use the AI chat interface to manage their own calendar events. As an End User, you might also interact with Personal-IQ as a client of a business (for example, booking an appointment on a business user’s booking page without logging in). End Users should use the platform only for personal and lawful scheduling purposes.
• Business Users (Booking Page Owners): This refers to users (often small business owners, freelancers, or organizations) who use Personal-IQ to set up and manage a booking page for their services. Business Users can create a public profile for their business, define services and availability, and receive bookings from End Users (their customers). As a Business User, you are responsible for all content you provide about your business (e.g., business name, description, service details, pricing, hours, and any images or logos). You must ensure that this content is accurate, lawful, and that you have the rights to use it. Business Users are also responsible for managing the appointments booked through the platform (e.g., honoring bookings or promptly communicating any changes to customers).
• Administrators (System Admins): This is an internal role for those operating or maintaining the Personal-IQ platform (the service providers). Admins have elevated privileges solely to monitor system health, manage the technical infrastructure, and support users. Admins do not monitor or access user calendar content or personal data except as needed for legitimate system purposes, such as debugging an issue at a user’s request or ensuring compliance with these Terms and the law. Admins are not third-party users of the service; they are bound by strict confidentiality and privacy obligations to protect user data.

When you create a Personal-IQ account (by signing in with Google), you will initially be an End User. If you choose to utilize business features (like creating a booking page), your account may be designated with a business role within the system, granting you access to business management features. You are responsible for maintaining the confidentiality of your account credentials (though note: Personal-IQ uses Google OAuth, so we do not ask for or store your Google password). Do not share your session or tokens with others. If you suspect unauthorized use of your account or any security breach, you must notify us immediately at our support contact.

You may not transfer or sell your Personal-IQ account to another party without our written consent. If an organization or business has an account and needs to change ownership (for example, a business owner handing over to a new owner), please contact support to discuss how to handle the transition in accordance with our policies.

4. Data and Security

Your privacy and data security are paramount to us. Personal-IQ is designed to minimize data storage and protect the information you do provide. We do not permanently store the content of your calendar events or the history of your conversations with the AI. We store only a minimal set of data as outlined below:

• Your Google account email address, which we use as your user identifier for login and to know which Google Calendar to access.
• Your Google OAuth refresh token and access token, which are encrypted and stored securely to enable Personal-IQ to perform calendar operations on your behalf. (These tokens are kept so you don’t have to reauthorize every time, but you can revoke them at any time by disconnecting Personal-IQ from your Google account.)
• Records of your agreement to our Terms of Service and Privacy Policy (including your email, IP at time of agreement, timestamp, and version of terms) for legal compliance purposes.
• If you are a Business User, information you input for your business profile (such as business name, contact info, services, and schedule) and any bookings made through your page (e.g., client name and contact for appointments). This data is stored so that the booking functionality can operate and so you and your clients have a record of appointments.

Beyond these, Personal-IQ may cache your recent AI conversation context temporarily to maintain continuity in the chat during your session, but this is not stored long-term or after logout. Prompt messages you send are transmitted securely to OpenAI for interpretation, but we do not keep logs of those messages in our database. Furthermore, no personal identifiers (like your email or full name) are included in the data sent to OpenAI; only the message content necessary for the AI to do its job is sent.

We employ best practices in security: communications with the platform are encrypted via HTTPS, sessions are secured and stored on the server side (in Redis) with secure cookies, and our frontend code adheres to a strict Content Security Policy (no third-party or inline scripts) to guard against cross-site scripting and data leaks. We also hash or redact sensitive information in our internal logs and never expose your personal data in log files. For more details on privacy and data handling, please refer to our Privacy Policy. By using Personal-IQ, you also agree to the data practices described there.

In summary, we ask that you acknowledge: (a) you understand Personal-IQ will interface with your Google Calendar data (with your permission) and use OpenAI to process your requests, and (b) you consent to our handling of data as necessary to provide the service. We will not use your data for any purposes outside the scope of Personal-IQ’s functionality, and we will not use your information to train AI models or for unrelated analytics. Your trust is important to us, and we strive to keep your data secure at all times.

5. Availability and Beta Disclaimer

Personal-IQ is currently offered as a beta service. While we aim to provide a reliable and useful platform, you acknowledge that the service is still under active development and may experience changes, updates, or occasional issues. Features may be added, modified, or removed as we refine the product. We do not guarantee that the service will be available at all times or that it will be free from errors or interruptions.

We may temporarily suspend the service (in whole or in part) for maintenance, updates, or to resolve technical problems. Whenever possible, we will try to schedule maintenance during low-usage times and, if it’s a planned downtime, we may provide advance notice via the website or email. However, there may be instances (especially in beta) where urgent fixes are needed without warning.

Because we depend on third-party services like Google Calendar and OpenAI, the availability of Personal-IQ can also be affected by the availability of those services. For example, if Google’s API is down or if OpenAI’s service is experiencing difficulties, Personal-IQ’s functionality may be limited or temporarily non-functional. We have rate limits and fallbacks in place (e.g., limiting how many AI or calendar requests can be made in a short time) to protect the service stability, but these might occasionally prevent or delay actions if limits are exceeded.

Beta Software Warning: As a beta user, you agree that you understand the service is provided “as is” during this phase. Features and performance may not be final. You might encounter bugs, and some features might not work exactly as expected. We greatly appreciate feedback during this period – if you run into any issues or have suggestions, please reach out to us. By using the beta, you accept that there could be unforeseen problems and agree that we will not be held liable for any consequences of such issues to the fullest extent permitted by law (see also “Limitation of Liability” below).

6. No Backup Guarantee

Personal-IQ itself does not maintain independent backups of your calendar data or conversations. The platform acts as a bridge to your Google Calendar, which is the primary store of your events. Any events created, modified, or deleted via Personal-IQ are reflected directly in your Google Calendar in real time. We do not separately save copies of your calendar events outside Google’s systems.

This means that if data is lost or changed in your Google Calendar (whether by your action, via Personal-IQ at your instruction, or by some error), we cannot restore it for you — you would need to rely on Google’s backup or recovery mechanisms (if any). Google Calendar does not typically offer user-facing backups for individual accounts (occasionally they have an “undo” for recent changes or Trash for deleted events in Google Calendar’s interface, which you might use if you accidentally remove something). We recommend that users be cautious when deleting or modifying events through any app.

If you require archiving or backup of your calendar data, we advise that you regularly export your Google Calendar through Google’s tools or take screenshots/notes of important information. The same goes for any data related to bookings (e.g., if you’re a business user, you might want to periodically download or note your upcoming appointments). While Personal-IQ’s database holds booking records, it is not designed as a long-term archival service and, as per our data practices, those records may be purged if you delete your account.

In summary, we make no guarantee that any content or data you access or generate via Personal-IQ will be backed up by us. You use the service with the understanding that your primary data remains on external systems (Google’s calendar, your email for notifications, etc.) and that you are responsible for maintaining your own backups if needed for critical information.

7. User Responsibilities and Acceptable Use

By using Personal-IQ, you agree to use the service responsibly and only for its intended purposes. This means:

• Lawful Use: You will not use Personal-IQ for any unlawful, illegal, or unauthorized purpose. This includes complying with all applicable local, national, and international laws and regulations. You will not use the service to schedule or facilitate any activity that is fraudulent, harmful, or violates any law (for example, you should not use it to schedule illicit transactions or harassing meetings).
• No Abuse or Disruption: You will not misuse the Personal-IQ platform. This includes refraining from attempting to hack, exploit vulnerabilities, or circumvent security or authentication measures of the service. You agree not to launch any automated systems (such as bots or scripts) against our service in a manner that sends more requests to the servers than a human could reasonably produce in the same time. You will not attempt to overwhelm or disrupt the service (no DDoS attacks, spamming the AI with nonsensical requests to degrade performance, etc.). Rate limits we set must be respected.
• No Reverse Engineering: You will not attempt to reverse engineer, decompile, or otherwise extract the source code of the Personal-IQ software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. The platform is offered as a service; you agree not to copy or modify it for your own competitive use.
• Use Your Own Account: You must use your own Google credentials to log in. Do not impersonate any other person or entity or misrepresent your affiliation with any person or entity. If you’re using the booking feature as a customer (without logging in), you must provide truthful information (such as your actual name and valid contact information) to the business you are booking with. Impersonation or providing false details could lead to account termination or the booking being canceled.
• Business User Obligations: If you are a Business User, you have additional responsibilities:
  • Ensure that any personal data of your customers collected via Personal-IQ (e.g., when someone books an appointment, their name and contact info) is handled in compliance with privacy laws. This means you should only use that data for managing the appointment (or related customer service) unless you have obtained the person’s consent for other uses. For example, do not add customers to marketing mailing lists without their consent just because they booked through the platform.
  • You are responsible for honoring the appointments booked through Personal-IQ or promptly canceling/rescheduling them if necessary (through the provided features), and for communicating any changes to your customers. Personal-IQ is only a facilitator; the actual contract for services (e.g., a haircut appointment, a consultation) is between you and the customer.
  • Refrain from posting any prohibited content on your booking page. This includes content that is obscene, defamatory, infringing, or otherwise violates any third-party rights or laws. We reserve the right to remove or request you to modify any business profile content that we deem inappropriate or unlawful.
• No Unauthorized Access: You will not try to access accounts or data that do not belong to you. For example, you should not attempt to use Personal-IQ with someone else’s Google account or attempt to retrieve data about another user’s calendar or bookings. Similarly, if you gain access to any feature or data that you reasonably should not have (due to a bug or glitch), you agree to stop and report it to us immediately, rather than exploiting it.
• AI Use Policy: The AI assistant is there to help with scheduling and related queries. You agree not to use it in ways that violate our or OpenAI’s usage policies — for instance, you won’t deliberately prompt it to generate disallowed content (such as extremely hateful, violent, or other prohibited outputs), and you understand that the AI’s responses are for general assistance and should be verified for accuracy. Do not rely on the AI for critical or time-sensitive decisions without checking (Personal-IQ is not a substitute for your own review of your calendar and commitments).

If you violate any of the above responsibilities or engage in behavior that we determine to be abusive or detrimental to the platform or other users, we reserve the right to take action. Actions may include warnings, suspension of your access, or termination of your account (as detailed in Section 9 on Termination). In serious cases, we may also take legal action or cooperate with law enforcement if laws are broken.

You are also responsible for any consequences arising from your misuse of Personal-IQ. For example, if you use Personal-IQ to send incorrect or duplicate meeting invitations and that causes confusion or loss, that is a result of your misuse. Similarly, business users are responsible for handling their client relationships; Personal-IQ just provides the tool.

Always use common sense and courtesy when using the platform. If you’re ever unsure whether something is allowed or appropriate, please err on the side of caution or consult us. We aim to foster a productive and respectful environment for all users of Personal-IQ.

8. Intellectual Property Rights

Personal-IQ and all of its content, features, and functionality (including text, software, code, images, and designs) are the exclusive property of IQ Kos AI Solutions and its licensors, and are protected by copyright, trademark, and other intellectual property laws. The “Personal-IQ” name and logo are trademarks of IQ Kos AI Solutions.

We grant you a limited, non-transferable license to use Personal-IQ for its intended purposes. You agree not to reproduce, distribute, create derivative works from, publicly display, or exploit any portion of the service without our prior written consent.

9. Disclaimers and Limitation of Liability

Provided “As Is”: Personal-IQ is provided on an “as is” and “as available” basis. We make no warranties or representations, either express or implied, about the reliability, accuracy, or suitability of the service for any purpose. To the fullest extent permitted by applicable law, we disclaim any and all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements or expectations, that it will achieve any intended results, or that it will be uninterrupted or error-free.

AI Output and Calendar Accuracy: You acknowledge that any information or suggestions provided by the AI (OpenAI’s system) within Personal-IQ are generated by an automated system. While we strive to configure the AI to be helpful and accurate, it can occasionally produce incorrect or nonsensical responses. You should not rely solely on AI outputs for critical decisions or information. Always verify important details (like event times, attendees, addresses, etc.) in your actual Google Calendar or with the relevant parties. Personal-IQ is a productivity aid; it is not infallible. We are not liable for any scheduling errors, missed appointments, or other issues that arise from incorrect interpretations or outputs by the AI.

No Liability for User Actions or Third-Party Acts: IQ Kos AI Solutions (the developers and operators of Personal-IQ) is not liable for the actions or omissions of users of the platform. Our service connects End Users and Business Users for booking and scheduling, but we are not a party to the appointments or agreements made between them. For example, if you book an appointment with a Business User through Personal-IQ and that business fails to honor the appointment or provides unsatisfactory service, that matter is between you and the business. Personal-IQ only facilitated the booking and is not responsible for what happens during or after that appointment. Similarly, if you are a Business User and a client doesn’t show up or violates your cancellation policy, that is outside the scope of our responsibility. We also have no control over, and assume no responsibility for, the content of external links (like any external websites a Business User might list) or any external communications outside our platform.

Limitation of Liability: To the maximum extent permitted by law, IQ Kos AI Solutions (Petrit Bahtiri and team) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, business interruption, or other intangible losses, arising from or in connection with your use of (or inability to use) Personal-IQ. This holds true even if we have been advised of the possibility of such damages. In no event will our total cumulative liability to you for any claims arising out of or relating to these Terms or the service exceed the amount of fifty Euros (€50) or the equivalent in local currency (or, if greater, the amount you have paid us for the service in the last 12 months, which at present is likely zero as the service is free during beta).

Specific Application: Without limiting the generality of the foregoing, IQ Kos AI Solutions is not liable for:

• Missed or duplicate events, reminders that fail to send or be received, or any scheduling conflicts or mishaps that occur via the use of Personal-IQ. You should not rely on Personal-IQ as your sole reminder system for critical or emergency matters (for example, do not use it as the only means to remind you of taking medication or attending a court date).
• Any damage to your computer, device, software, or data that results from use of the Personal-IQ app or website. We take security seriously, but we cannot guarantee the service will be free of harmful components, so you use it at your own risk.
• Any issues arising from the unavailability or malfunction of Google’s or OpenAI’s services. If Google Calendar’s API or OpenAI’s API experiences outages or bugs, those are outside our control. We will do our best to handle such situations gracefully, but we are not responsible for downtime or errors attributable to these third-party providers.

Personal-IQ is provided on an “as is” and “as available” basis without any warranties or guarantees of any kind. We do not warrant that the service will be uninterrupted, error-free, or that it will meet your specific requirements or expectations.

IQ Kos AI Solutions is not liable for missed events, incorrect reminders, scheduling mistakes, or any losses arising from reliance on this platform. Personal-IQ is intended as a productivity aid, not a critical alert system. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages resulting from your use of Personal-IQ.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, the liabilities of IQ Kos AI Solutions and its affiliates will be limited to the greatest extent permitted by law. These provisions on limitation of liability will survive termination of your use of Personal-IQ.

10. Indemnification

You agree to indemnify and hold harmless IQ Kos AI Solutions, its affiliates, and their employees from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of Personal-IQ or your violation of these Terms of Service.

11. Termination

By You: You are free to stop using Personal-IQ at any time. You may disconnect Personal-IQ from your Google account (which effectively terminates our ability to provide services to you) and, if you wish, request that we delete your account and any stored data as described in our Privacy Policy. Terminating your use is as simple as logging out and revoking access or contacting us for account deletion. Keep in mind that termination by you will not absolve you of any obligations incurred prior to termination (for example, if as a Business User you have pending appointments with customers, you should handle those commitments or inform your customers even if you quit using our platform).

By Us: We reserve the right to suspend or permanently terminate your access to Personal-IQ (or certain features of it) under the following circumstances:

• If you violate any provision of these Terms of Service or our Privacy Policy.
• If you engage in behavior that is illegal, abusive, or that jeopardizes the security, functionality, or integrity of our platform or the data of other users.
• If we receive a credible complaint of misconduct (for example, a business user seriously misusing customer data or an end user attempting to hack the system).
• If your Google account access is revoked or if required by Google (for instance, if Google informs us that your use of their API via our service is violating their terms).
• For prolonged inactivity of your account (if we implement an inactivity policy, we will communicate what that is — typically this might mean if you haven’t logged in for a very long period, we might deactivate your account, especially during beta, to free resources, but we would attempt to notify you first).
• If required by law or government order.

In most cases of non-extreme violations, we will attempt to send you a warning or reach out to discuss the issue before terminating your account. However, in severe cases (for example, detected fraud or a security threat), we may deactivate or block access immediately to protect the system and others.

Effect of Termination: Upon termination of your account by either party, you will lose access to the Personal-IQ platform. Any data we have stored on your behalf will be handled as described in the Privacy Policy (generally deleted or anonymized, except any data we are required to keep by law). Events already created in your Google Calendar will remain in your Google account (unless you choose to delete them separately). If you are a business user and we terminate your account, we may in our discretion cancel any upcoming bookings on your behalf and/or notify your customers that you are no longer on the platform, to prevent confusion.

Even after termination, certain provisions of these Terms will remain in effect by their nature. These include sections related to intellectual property, disclaimers, limitation of liability, indemnity, and any other clauses that by logical interpretation are meant to survive termination.

Termination of an account does not prevent either party from seeking any available legal remedies for any violation of the Terms that occurred prior to termination.

12. Changes to Terms

We may revise or update these Terms of Service from time to time. When we do so, we will change the “Effective Date” at the top of the Terms and, if the changes are significant, we will provide additional notice to you (for example, by posting a notice on our website/app interface or notifying you via email). It is your responsibility to review these Terms periodically, especially when a notice of changes has been given, to stay informed about the conditions of your use of Personal-IQ.

Your continued use of Personal-IQ after any such update constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using Personal-IQ and may disconnect your Google account and/or request account deletion. We’ll be sad to see you go, but respecting the Terms is mandatory for all users.

Please note that no modification of these Terms by you (for example, handwritten changes or statements in communications) will be binding on us unless explicitly agreed to in writing by an authorized representative of IQ Kos AI Solutions.

13. Governing Law and Dispute Resolution

These Terms of Service and any dispute arising from or relating to the service will be governed by the laws of the Republic of Kosovo, without regard to conflict of law principles. You agree that any dispute or claim arising out of or in connection with these terms or your use of Personal-IQ shall be subject to the exclusive jurisdiction of the courts located in Kosovo, unless applicable law stipulates otherwise.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions of the Terms will remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and IQ Kos AI Solutions regarding your use of Personal-IQ, and supersede any prior agreements or communications relating to the service.
